What are cookies?
Cookies are a small data record that is generated by a web server, sent via the Internet and stored on your end device with the help of your browser programme. The website essentially uses ‘cookies’ to recognise users or their end devices, to store the user's preferences or information for the duration of surfing or in the event of a return. Cookies are also used to display behaviour-based advertising and to control advertising content.
What types of cookies are there?
First-party cookies
Are sent and read exclusively by the domain of the service provider.
Third-party cookies
Are sent and read by domains of other service providers.
Session cookies (session-id)
Temporary cookies that are automatically deleted when the browser is closed. Session cookies enable the user's movements on the website to be recognised so that information is retained. Without cookies, websites have no "memory".
Persistent cookies
Persistent cookies that need to be deleted manually or that delete themselves after a specified period of time. These cookies help the website to remember the user and their settings; e.g. language selection, menu preferences, internal bookmarks or favourites.
How can the user reject cookies?
The most common browsers allow the user to control the storage of cookies, e.g. Chrome: chrome://settings/content/cookies; Firefox: about:preferences#privacy, etc.
How can the user delete cookies?
The most common browsers allow the user to delete cookies that have already been saved (usually under the ‘Settings’ or ‘Privacy’ section).
When may the service provider use cookies?
The service provider is authorised to store cookies on the (informed) user's terminal equipment for the sole purpose of carrying out or facilitating the transmission of a communication over an electronic communications network or, where strictly necessary, to provide a service explicitly requested by the subscriber or user (Art 5 (3) ePrivacy Directive). In Opinion 4/2012 on the exception to the cookie consent requirement, the Art 29 Working Party declared the following cookies to be permissible:
- User cookies (session ID) such as first-party cookies to track the user's input when completing online forms, shopping carts, etc. for the duration of a session or persistent cookies, which in some cases are limited to a few hours
- Authentication cookies to identify the user after login for the duration of a session
- User-centric security cookies used to detect authentication errors for a limited duration
- Player cookies for multimedia content used to store technical data for the playback of video or audio content for the duration of a session
- Load-balancing cookies for the duration of the session
- Cookies for user interface customisation, e.g. language or font settings, for the duration of a session. e.g. settings for language or font, for the duration of a session (or slightly longer)
- Social plug-in cookies for sharing third-party providers for logged-in members of a social network.
In addition, the user's consent to the storage of cookies is required.
